Negotiation and Settlement

Good morning, San Diego! I’m Brenda Cortez reporting live for Channel 7 News. Today we’re talking with Richard Morse, the seasoned attorney at Morse Injury Law, about a critical stage in personal injury cases: negotiation and settlement. Richard, welcome to the show.

The Art of Negotiation

Thank you for having me, Brenda. Negotiation and settlement are often the heart of a successful personal injury case. Ordinarily, after we’ve thoroughly investigated the accident, gathered evidence, and built a strong case, we enter into negotiations with the insurance company representing the at-fault party.

This stage involves skilled communication and a deep understanding of legal precedents and injury valuations. Our goal is to secure a fair settlement that compensates our clients for their medical expenses, lost wages, pain and suffering, and other damages resulting from the accident.

Mediation: A Bridge to Resolution

If negotiations hit a snag, we may suggest mediation as an alternative dispute resolution method. In mediation, a neutral third party helps facilitate discussions between us and the insurance company, aiming to find common ground and reach a mutually agreeable settlement.

This process can be highly effective in avoiding costly and time-consuming litigation while still ensuring our clients receive just compensation. Consequently, it’s often a preferred route for many involved parties.

Navigating Challenges

Brenda, there have been instances where insurance companies were reluctant to offer fair settlements, even with compelling evidence. I recall one case involving a young woman who suffered a severe back injury in a car accident. The insurance company initially offered a paltry sum that barely covered her medical bills.

Notwithstanding their lowball offer, we refused to back down. We presented irrefutable medical records and expert testimony demonstrating the long-term impact of her injuries. Through persistent negotiation and strategic legal arguments, we ultimately secured a settlement significantly higher than their initial offer.

According to a recent study by the Insurance Research Council, only about 4% of personal injury cases go to trial. This highlights the importance of skilled negotiators who can effectively advocate for their clients’ rights during the settlement phase.
