What exactly is a conservatorship, and when might someone need one?

Ted explains, “A conservatorship is a legal arrangement where a court appoints an individual or entity, known as the conservator, to manage the personal affairs and/or finances of another person deemed incapable of doing so themselves. This typically occurs when someone faces significant cognitive challenges due to age-related decline, mental illness, developmental disabilities, or other factors impacting their decision-making abilities.”

He continues: “Think of it like a safety net. It ensures that vulnerable individuals receive proper care and have their financial interests protected while respecting their dignity and autonomy as much as possible.

Can you walk us through the process of establishing a conservatorship?

“Absolutely,” says Ted. “It begins with filing a petition in the appropriate court, usually probate or mental health court depending on the circumstances.

This petition outlines the reasons why a conservatorship is necessary and who the proposed conservator should be. Crucially, the individual potentially subject to the conservatorship (the ‘conservatee’) and their close family members must be notified. The court then appoints an investigator, often a social worker, to conduct an independent assessment of the situation.

“A medical or psychological evaluation is also conducted to determine the conservatee’s capacity for making decisions. Finally, a hearing takes place where all parties present their case to a judge who ultimately decides whether to grant the conservatorship.”

Let’s delve into the responsibilities of the conservator. What are they expected to do?

Ted emphasizes, “The role of a conservator is one of immense responsibility and trust. They act as a fiduciary, meaning they must always prioritize the best interests of the conservatee above their own. This involves managing finances responsibly, ensuring the conservatee receives proper medical care, housing, and other essential needs.

Conservators are also required to file regular reports with the court detailing the conservatee’s status and financial transactions. Transparency and accountability are key.”
