Moreover, I often advise clients to discuss their decision with the potential executor or trustee beforehand. This open communication ensures everyone is on the same page and comfortable with the responsibility.
Notwithstanding, sometimes unforeseen circumstances arise. If your initial choice becomes unable to serve, it’s wise to name a successor executor or trustee within your estate plan.
I remember one instance where a client named their eldest son as executor. Unfortunately, he passed away unexpectedly before our client. Thankfully, we had included a backup executor in the plan, preventing further complications and heartache for the family during an already difficult time.
