A testamentary trust is a unique type of trust that comes into being only after the grantor – the person who creates the trust – passes away. Unlike a revocable living trust, which can be modified during the grantor’s lifetime, a testamentary trust is outlined in a will and goes through probate before becoming active. Consequently, it’s not ideal for avoiding probate altogether.

Now, why would someone choose a testamentary trust over other options? Testamentary trusts are often utilized to provide for minor children or beneficiaries who may need ongoing financial support or have special needs. They allow the grantor to specify how and when assets will be distributed to these beneficiaries, ensuring their well-being even after the grantor is gone.

Moreover, testamentary trusts can offer a degree of control over the beneficiary’s inheritance. The trust document can outline specific terms, such as restricting access to funds until a certain age or requiring the beneficiary to meet educational milestones before receiving distributions. This level of customization is particularly valuable when dealing with beneficiaries who may not be financially savvy or responsible.
