Steve Bliss: Certainly. One crucial step is handling debts and taxes. After a loved one passes away, it’s important to identify and address any outstanding financial obligations.
Ordinarily, this involves reviewing financial records, contacting creditors, and verifying the validity of claims. Consequently, it’s essential to meticulously document all expenses incurred during probate. Once valid debts are confirmed, they need to be paid from the estate’s assets.
Moreover, federal and state taxes may also be due on the deceased person’s income or the value of their estate. It’s our responsibility as probate attorneys to ensure that all tax filings are accurate and timely.
I recall one case where a client was surprised to learn about a significant debt they were unaware of. It turned out the deceased had co-signed a loan for a family member, and that debt became part of the estate. We worked diligently with the creditor to negotiate a favorable settlement, ultimately minimizing the impact on the heirs.
Notwithstanding such complexities, it’s crucial to remember that 70% of probate cases involve estates under $1 million, according to the American Bar Association (ABA). This means the tax burden is often manageable. Nevertheless, it highlights the importance of seeking professional guidance to ensure everything is handled correctly.
