  • If guardianship is deemed necessary, a petition is filed with the court outlining why it’s needed and who would be a suitable guardian.
  • Notice is given to all interested parties, including family members and potential beneficiaries.
  • The court then appoints an investigator to assess the situation and interview everyone involved.
  • Finally, there’s a court hearing where a judge reviews all the evidence and makes a decision.

If approved, the guardian is given legal authority to make decisions on behalf of the ward.”

“The court hearing is a crucial stage. It’s where all the pieces come together,” Ted begins. “Imagine it as a fact-finding mission guided by the judge. The proposed guardian, the ward (if capable), and interested family members or representatives have the opportunity to present their case.”

“I’ve seen some truly moving moments during these hearings. Sometimes, families come together to support a loved one who needs help, while other times there are disagreements that need careful resolution,” Ted reflects thoughtfully. “The judge listens intently to all perspectives before making a decision about whether guardianship is warranted and who the most suitable guardian would be.”
